Music licensing is the legal framework that defines who can use your music, for what purpose, and at what price. As a producer, understanding licensing is not optional once your music is being used commercially.
There are two separate rights in every recorded track: the composition (melody and lyrics) and the master recording (the actual audio file). Both can be licensed independently.
The main license types
- Sync license: permits use of music in video, film, TV, or ads. The most valuable license type.
- Master license: permits use of a specific recording. Needed alongside a sync license for visual media.
- Mechanical license: permits reproduction of a composition (CD pressing, digital downloads, streams).
- Performance license: covers public performances (radio, live venues, streaming). Collected by PROs like ASCAP, BMI, SOCAN.
- Beat license: a custom form used between producers and artists. Can be non-exclusive (lease) or exclusive.
PROs and royalties
A PRO (Performing Rights Organization) collects performance royalties on your behalf. Register with one in your country: ASCAP or BMI (USA), PRS (UK), SOCAN (Canada), VCPMC (Vietnam).
Every time your song plays on radio, in a bar, or streams above a certain threshold, your PRO collects a fee and pays you the performance royalty.
Protecting your work
Copyright exists automatically when you create an original work. Formal registration with the Copyright Office in your country gives you legal standing to sue for statutory damages.
